Oklahoma Murder


1.       What is the difference between murder and homicide? What are the categories of each? Murder and homicide are both used to describe the act of killing another human being. The easiest way to describe the differences between murder and homicide is that homicide is the killing of another human being, while murder requires the intent to kill another human being. Homicide can be used to describe any death where another person is at fault, but there are mitigating circumstances that can influence the charge of homicide. When someone is convicted of murder, however, they are not only convicted of a homicide, but also the malicious intent to kill. In the United States, we have terms like "justifiable homicide" and "non-criminal homicide" that are used to describe acts of homicide where there is no "mens rea" involved. The U.S. requires that the prosecution in a criminal trial prove both actus reus and mens rea in a criminal crime; the former translates as "guilty mind" and the latter refers to "guilty act". Actus reus is simply the proof that a defendant committed a criminal act, while mens rea is a little more complicated. In order to prove mens rea, the prosecution must show that the defendant either had an intent to commit the crime or acted with criminal negligence. With this in mind, you must understand that homicide is not always illegal, while murder is always illegal.

Authorities investigate jail death of man accused of killing parents

Ross Alan Holloway (32) was being charged with the death of his parents before he was found dead in his jail in Okfuskee County. Before, being found dead Holloway allegedly killed his parents Denver and Martha Holloway. His parents' bodies were found March 11 by OSBI agents and Okfuskee County officials, according to a court affidavit filed in Ross Holloway's murder charges.

A day after Denver and Martha Holloway's deaths, officers in Le Flore County stopped Ross Holloway, who admitted to smoking methamphetamine hours earlier, according to the affidavit.

Authorities found a .22-caliber revolver inside Ross Holloway's vehicle, along with five spent shell casings inside the cylinder, according to the OSBI.

Denver and Martha Holloway died from multiple gunshot wounds, according to a medical examiner's report.  According to his death report, there was sign of foul and he was definitely in his cell alone. So there could be a possibly that he committed suicide.

Oklahoma-Mob Violence


1.       What is mob violence? A mob is defined as a group or collection of people involved in lawless behavior. It can also be defined as a riotous crowd of people.  Lynching’s, riots, bullying, gangs violence and etc.

 

Ø  People grow up in violence, taught violence, seek violence themselves or join because economic   circumstance.  Some individuals growing learning from they’re guardians that it is ok to hate a certain group or people in general. Some parents teach their children to be violent at a young age. Some individuals seek violence as they get older because that is something that just interest them, violence is all they know, they think it is cool or maybe their friends are involved in violence. Some people are in low income areas and involve themselves in violence for income reasons.

Okla. pharmacist shoots robber in head, then again as teen lay on floor

 

                A pharmacist, Jerome Ersland (57) has been charged with first degree murder charges. Back in 2009, when he was in a drug store, two black guys decided to rob the place. Ersland felt threatened so he pulled out a gun and shot both guys. He shot one guy in the head and chased the other guy away. After the other guy ran away, and turned his attention back to the other guy still in the store. He pulled another gun from behind the counter and then shot the wounded teenager five more times. He was released from jail on a $100,000 bail which was paid by an anonymous person. He has a lot of supporters, who believed he was in the right and supported his military background. The teenager Ersland shot and killed was a boy name Antwun Parker (16). The reason the District Attorney is charging Ersland him with first degree murder is because the five additional shots is what causes the boy’s fatality. The District Attorney claims that Ersland could have claimed only the first shot as self defense because the boy was down and defenseless.  The other teen that Ersland chased away is a 14-year-old boy. The name is not known but he will face murder charges due to his involvement in the robbery.

Ø  With the people of Oklahoma there is no gray area, they believe what Ersland did was right. I don’t know if it’s because he is white and both robbers are black but the common goal of the people is that they have a right to protect themselves.
