OKLAHOMA:CHILD VICTIMIZATION


1.       What do you consider child abuse? I consider child abuse any emotional, physical, or psychological trauma experienced by the child that is brought on by the parent. I believe if the parent intended reason isn’t to teach the child right from wrong then it is child abuse.

2.       Do you think spanking is child abuse? Do you think spanking should be allowed? I do not believe it is child abuse but it can be and can lead to it. I think spanking a child for deviant behavior is ok but spanking them for your own satisfaction is not ok and is child abuse. I think spanking a child should be allowed only as a reinforcement for right and wrong. When I was little I got spanked for doing something bad and that taught me not to do that certain thing again. I think a spanking teaches children boundaries and that is a lesson that they can take with them into adulthood and pass down to their own children.

3.       When should punishment become a public concern? I think that society should only be concerned if domestic violence is involved. If the child does not have bruises, is not getting beat regularly, is not experiencing emotional torture, watching parents constantly fight then society has no right to stick their nose in people’s households. I think spankings in public are ok as long as they are not brutal and harmful to child. Children tend to do things in public because they feel they can get away with things when other people are around. I think spanking will teach them that boundaries need to be set and they cannot just act out anywhere and as they please. I do believe talking to them and taking things away works just as well too but if not then spankings can be a great addition. I don’t believe parents should get scrutinized for spanking their child as long as they are not punching them upside the head which is very awful.

4.       What is an acceptable form of public punishment? I think your personal belongings are ok such as your hand.

5.       What is an unacceptable form of public punishment? I think anything besides punching and beating your child with an object. I seen parents hit their children with shoes; it was very scary and crazy. I think you should leave the belts at home.

6.       Oklahoma Child Pornography Law: Child pornography is not only an Oklahoma sex offense, but a Federal sex crime. Punishments for producing, distributing, downloading, and possessing child pornography are swift and severe. A child pornography conviction in Oklahoma can result in a sentence of up to 20 years in a state or Federal prison and a maximum fine of $25,000. Furthermore, Oklahoma law stipulates those convicted of child pornography must serve at least 85% of their prison term before becoming eligible for parole. After release from prison, any person convicted of child pornography must register as an Oklahoma Sex Offender.

7.       Oklahoma “Sexting” Law: “Sexting” is not a legal term; rather, it is a term to signify an Oklahoma sex crime committed using cell phones, PDAs, or other mobile devices. Common criminal charges associated with sexting include: Distribution of child pornography, Possession of child pornography, Indecent, or lewd proposals to a minor, Solicitation of a minor.  Each of these crimes involving a minor mandates lifetime registration as an Oklahoma Sex Offender upon conviction. One unique aspect of sexting crimes is that a minor under 18 can be considered both the victim and the perpetrator of distribution of

8.       Child pornography if he or she sends nude, semi-nude, or sexually explicit photographs of himself or herself. Those who receive the sexting images can be charged with possession of child pornography; if they send the images on to someone else, they can also be charged with distribution of child pornography, even if the message did not originate with them. Public service announcements geared toward teens highlight the personal ramifications and tarnished reputation associated with sexting. However, the legal consequences are much more serious. 9.       ARTICLE:

A man name Phillip Hudson, Jr. (24) is charged with three counts of child abuse in Tulsa County District Court. Hudson was arrested on an accusation that he used a stun gun to discipline the 5-year old he was babysitting. The incident was reported to the police by the child’s teacher after he complained of pain in his shoulder and arm.  Hudson also hit the 5-year old with a board on his shoulder and elbow. The little boy said Hudson hit him because he refused to do his homework. After speaking to social workers, he was examined by the medical examiners and the burn marks were visible on the boy’s body. Hudson is said to have been a neighbor and ex-boyfriend of the boy’s mother.  Hudson reasoning for using the stun gun instead of spanking the boy was to not leave any bruises. The stun gun left visible burn marks on the little boy’s skin. Hudson’s bail is set to $300,000.


 

Reading this article versus the other articles for all the other blogs was different. Reading about a man was thinking it was ok to stun gun a child was very difficult. I think that man is very sick and that this country and world needs to take child victimization more serious because it does happen. Reading and hearing about children getting abused does cause emotional arousal in anyone.

Oklahoma Murder


1.       What is the difference between murder and homicide? What are the categories of each? Murder and homicide are both used to describe the act of killing another human being. The easiest way to describe the differences between murder and homicide is that homicide is the killing of another human being, while murder requires the intent to kill another human being. Homicide can be used to describe any death where another person is at fault, but there are mitigating circumstances that can influence the charge of homicide. When someone is convicted of murder, however, they are not only convicted of a homicide, but also the malicious intent to kill. In the United States, we have terms like "justifiable homicide" and "non-criminal homicide" that are used to describe acts of homicide where there is no "mens rea" involved. The U.S. requires that the prosecution in a criminal trial prove both actus reus and mens rea in a criminal crime; the former translates as "guilty mind" and the latter refers to "guilty act". Actus reus is simply the proof that a defendant committed a criminal act, while mens rea is a little more complicated. In order to prove mens rea, the prosecution must show that the defendant either had an intent to commit the crime or acted with criminal negligence. With this in mind, you must understand that homicide is not always illegal, while murder is always illegal.

Authorities investigate jail death of man accused of killing parents

Ross Alan Holloway (32) was being charged with the death of his parents before he was found dead in his jail in Okfuskee County. Before, being found dead Holloway allegedly killed his parents Denver and Martha Holloway. His parents' bodies were found March 11 by OSBI agents and Okfuskee County officials, according to a court affidavit filed in Ross Holloway's murder charges.

A day after Denver and Martha Holloway's deaths, officers in Le Flore County stopped Ross Holloway, who admitted to smoking methamphetamine hours earlier, according to the affidavit.

Authorities found a .22-caliber revolver inside Ross Holloway's vehicle, along with five spent shell casings inside the cylinder, according to the OSBI.

Denver and Martha Holloway died from multiple gunshot wounds, according to a medical examiner's report.  According to his death report, there was sign of foul and he was definitely in his cell alone. So there could be a possibly that he committed suicide.

Oklahoma-Mob Violence


1.       What is mob violence? A mob is defined as a group or collection of people involved in lawless behavior. It can also be defined as a riotous crowd of people.  Lynching’s, riots, bullying, gangs violence and etc.

 

Ø  People grow up in violence, taught violence, seek violence themselves or join because economic   circumstance.  Some individuals growing learning from they’re guardians that it is ok to hate a certain group or people in general. Some parents teach their children to be violent at a young age. Some individuals seek violence as they get older because that is something that just interest them, violence is all they know, they think it is cool or maybe their friends are involved in violence. Some people are in low income areas and involve themselves in violence for income reasons.

 

2.       Article: Killing stirs furious debate over vigilante justice

                A pharmacist, Jerome Ersland (57) has been charged with first degree murder charges. Back in 2009, when he was in a drug store, two black guys decided to rob the place. Ersland felt threatened so he pulled out a gun and shot both guys. He shot one guy in the head and chased the other guy away. After the other guy ran away, and turned his attention back to the other guy still in the store. He pulled another gun from behind the counter and then shot the wounded teenager five more times. He was released from jail on a $100,000 bail which was paid by an anonymous person. He has a lot of supporters, who believed he was in the right and supported his military background. The teenager Ersland shot and killed was a boy name Antwun Parker (16). The reason the District Attorney is charging Ersland him with first degree murder is because the five additional shots is what causes the boy’s fatality. The District Attorney claims that Ersland could have claimed only the first shot as self defense because the boy was down and defenseless.  The other teen that Ersland chased away is a 14-year-old boy. The name is not known but he will face murder charges due to his involvement in the robbery.

Ø  With the people of Oklahoma there is no gray area, they believe what Ersland did was right. I don’t know if it’s because he is white and both robbers are black but the common goal of the people is that they have a right to protect themselves.

Oklahoma-HATE CRIMES

Hate Crimes-OKLAHOMA


1.       The total population covered: 286,010,550

2.      Oklahoma

Ø  Covered under state law: Bias-Motivated Violence and Intimidation. Civil actions such as race, religion, ethnicity, and disability. Also, institutional Vandalism and Data Collection.

Ø  Covers damage to real or person property of another because of that person's race, color, religion, ancestry, national origin, or disability.

 

Ø  Prohibits assault, battery, or threats toward another because of that person's race, color, religion, ancestry, national origin, or disability. Also covers damage to property of another because of that person's race, color, religion, ancestry, national origin, or disability.

 

Ø  Covers willful injury to any house of worship or any part thereof, or property therein.

 

Ø  Not covered under state law: Civil actions such as sexual Orientation and gender. Also, Training for Law Enforcement Personnel.

3. Oklahoma
It is unlawful to harass, threaten, intimidate, or assault a person based on race, color, religion, ancestry, national origin, or disability. It is also unlawful to destroy or vandalize any real or personal property of a person based on the above reasons. Institutional vandalism is unlawful and is considered a felony in this state.  Institutional vandalism means defacing items like books, buildings, furniture, or even instruments.  Also, The Oklahoma State Bureau must report hate crimes and develop agencies that report the hate crimes.  Law enforcement training for hate crimes is not required for policemen.
Oklahoma defines hate crimes as: to maliciously harass, threaten, or intimidate based on someone’s race, color, religion, ancestry, national origin, or disability. Also maliciously destroying, defacing, damaging, or vandalizing any real or personal item of someone’s because of on race, color, religion, ancestry, national origin, or disability.
4.     HATE CRIME SUSPECTED AFTER GAY MAN BURNED BY FIREBOMBING IN OKLAHOMA
A guy name Jon Ferguson woke up on a Saturday morning to his car being vandalized by to guys that were homophobic. Both guys were in the process of lighting his car on fire and before Jon could run back into his house to safety he had already suffered burns. When he had arrived at the hospital the doctors told him he suffered first and second degree burns. He was also told that fag was spray painted on his car. Jon told the police that he didn’t get a good look at the guys because they had masks on and they had run off. The police did not take this incident as a hate crime because sexual orientation is not covered under the hate crimes law and Oklahoma does not fully accept the LGBT community.  So the police reported the incident as arson and they are still looking into the incident, even though they still have not found the perpetrators. The victim is thinking about resuming his life as a heterosexual male instead of a homosexual, in order to avoid hate crimes because he believes the Oklahoma law enforcement will not protect him.
5.    WHITE VICTIMIZATION IN AMERICA (MEDIA)
A.      The video explains how current president Barack Obama signed the Matthew Shepard and James Byrd, Jr. Hate Crime Prevention Act. Conceived as a response to the murders of Matthew Shepard and James Byrd, Jr., the measure expands the 1969 United States federal hate-crime law to include crimes motivated by a victim's actual or perceived gender, sexual orientation, gender identity, or disability.
B.      In the video a white couple was murdered in Knoxville, Tennessee by five blacks. The crime was malicious and hateful. Channon Christian and Christopher Newsom (the couple) were kidnapped, tortured/ rapped and later killed. Channon was only 21 and Christopher was only 23 at the time of their death. They were rapped and dumped Newsom’s body at the railroad tracks. They also left his body in flames at the tracks. After raping and torturing Christian, they stuffed her body in a trash can. They five people involved in were found guilty in the killing of the couple.  Eric Boyd, Letalvis Cobbins, Lemaricus Davidson, George Thomas, and Vanessa Coleman were the five defendants in the case. Eric Body was found guilty of being an accessory in the murders and sentenced to 18 years in prison. Letalvis Cobbins (26) was found guilty: Sentenced to life without parole for first-degree murder and rape in August 2009. Lemaricus Davidson (28) was found guilty: Sentenced to death by lethal injection for first-degree murder and rape in October 2009. George Thomas (26) found guilty: Sentenced to life without parole for first-degree murder and rape in December 2009. Vanessa Coleman (21) Not guilty of first-degree murder charges. Found guilty of facilitation in the death and rapes of Channon Christian; not guilty for any charges involving Chris Newsom in May 2010.

1.       FBI Statistics:

2.       Oklahoma Statue of Limitations:

Ø  Incest and forcible sodomy are both felonies.

Ø  Sexual battery is a felony.

Ø  Lewd or indecent proposals or an act upon a child under 16 is a felony.


Rape is considered a first degree crime:

Ø  if the offender is over the age of 18 and the victim and the victim is under the age of 14

Ø  if the victim is intoxicated and the offender knows this and uses this to his advantage

Ø  if the offender uses force or violence to execute crime

Ø  Offender commits rape by instrumentation that results in bodily harm

Ø  Offender commits rape by instrumentation, and victim is under 14

Ø  Otherwise, rape is in the second degree

Ø  If convicted of 1st degree murder, it is punishable by death or life in a state penitentiary in Oklahoma.


3.       Oklahoma Definition of Rape:

A.      Rape is an act of sexual intercourse involving vaginal or anal penetration accomplished with a male or female who is not the spouse of the perpetrator and who may be of the same or the opposite sex as the perpetrator under any of the following circumstances:

1. Where the victim is under sixteen (16) years of age;

2. Where the victim is incapable through mental illness or any other unsoundness of mind, whether temporary or permanent, of giving legal consent;

3. Where force or violence is used or threatened, accompanied by apparent power of execution to the victim or to another person;

4. Where the victim is intoxicated by a narcotic or anesthetic agent, administered by or with the privities of the accused as a means of forcing the victim to submit;

5. Where the victim is at the time unconscious of the nature of the act and this fact is known to the accused;

6. Where the victim submits to sexual intercourse under the belief that the person committing the act is a spouse, and this belief is induced by artifice, pretense, or concealment practiced by the accused or by the accused in collusion with the spouse with intent to induce that belief. In all cases of collusion between the accused and the spouse to accomplish such act, both the spouse and the accused, upon conviction, shall be deemed guilty of rape;

7. Where the victim is under the legal custody or supervision of a state agency, a federal agency, a county, a municipality or a political subdivision and engages in sexual intercourse with a state, federal, county, municipal or political subdivision employee or an employee of a contractor of the state, the federal government, a county, a municipality or a political subdivision that exercises authority over the victim; or

8. Where the victim is at least sixteen (16) years of age and is less than twenty (20) years of age and is a student, or under the legal custody or supervision of any public or private elementary or secondary school, junior high or high school, or public vocational school, and engages in sexual intercourse with a person who is eighteen (18) years of age or older and is an employee of the same school system.

B. Rape is an act of sexual intercourse accomplished with a male or female who is the spouse of the perpetrator if force or violence is used or threatened, accompanied by apparent power of execution to the victim or to another person.


4.      OKLAHOMA: “Bail denied for Oklahoma man in Wisconsin sexual assault case”

A name Glendon Gouker (41) is accused of sexual assaulting a woman in 1990 and killing two people in 1992. His two victims were Tanna Togstad (23) and Tim Mumbrue (35).  He is accused of stabbing both victims to death. He appeared in court earlier this month and they denied his bail due to the severity of the charges. He has yet to be sentenced for his crimes.

Intimate Partner Abuse/Violence

Oklahoma state law protects:

1. Current spouse, former spouse, current or former spouse of a present or current spouse, children, parents, foster parents, or anyone related by blood or marriage from assault or battery. Those who are convicted of assault or battery for the first time can spend up to a year in jail and can be fined up to $5,000 and the second offense will be at least 4 years with the $5,000 fine as well.
